Terms of Service

1. Acceptance of terms

By accessing or using the Attestify OS platform, APIs, or website at www.attestifyos.com(the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service. These Terms form a legally binding agreement between you (“Customer”) and Attestify OS (“Attestify”, “we”, “us”).

2. The Service

Attestify OS provides developer infrastructure for AI agent workflows, including an x402-based payment routing layer, governance controls, cryptographic receipts, budget enforcement, agent memory management, and execution logging. The Service is deployed on the Base network (EIP-155 chain ID 8453) and settles peer-to-peer payments in USDC. Subscription plan management and recurring billing are handled separately via Stripe. Features and API limits vary by plan as described on our pricing page. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Accounts, API keys, and multi-tenant access

The Service supports multiple access roles. Your role determines the scope of actions available to you:

  • Operator (admin): full platform access, including key provisioning, subscription management, webhook configuration, and access to admin-only endpoints. Authenticated via ATTESTIFY_ADMIN_KEY.
  • Tenant: scoped API access provisioned by the operator. Tenant keys (prefixed atst_) grant access to the APIs and features authorised for that tenant only. Tenant keys may be further scoped by tenant name.
  • Founder: elevated access within the Founder dashboard and associated routes, as configured by the operator.

You are responsible for maintaining the confidentiality of your API key and account credentials. API keys may not be shared, resold, or transferred without our written consent. You are liable for all activity conducted under your key. Notify us immediately at hello@attestifyos.com if you believe your key has been compromised.

4. Payments — Stripe and x402/USDC

The Service operates two separate payment systems, and both may apply to your account:

  • Stripe (subscription billing): recurring plan fees are charged via Stripe. Current plans are Builder (£49/month GBP or $62/month USD) and Enterprise (£299/month GBP or $379/month USD). Stripe billing is subject to Stripe's Terms of Service. Subscription fees are charged in advance, renew automatically, and are non-refundable except as required by law. You may cancel before your next renewal date to avoid further charges. Stripe may charge currency conversion fees where your billing currency differs from your bank's base currency.
  • x402 / USDC (pay-per-call): per-API-call fees are charged in USDC on the Base network using the x402 payment protocol. Fee amounts are displayed at the time of each request. All x402 transactions are on-chain and irreversible once settled. You are solely responsible for any network gas fees associated with Base network transactions.

We reserve the right to change pricing on 30 days' written notice. Continued use after the notice period constitutes acceptance of the new pricing. Stripe subscription invoices will reflect any price changes at the next renewal date.

5. Webhooks and delivery

The Service delivers outgoing webhook events to URLs you configure. Webhooks are signed with an HMAC-SHA256 signature in the X-Attestify-Signature header to allow you to verify delivery authenticity. You are responsible for:

  • Configuring a publicly reachable endpoint capable of receiving and acknowledging webhook deliveries promptly
  • Verifying the X-Attestify-Signature header on each delivery to prevent spoofing
  • Handling delivery failures gracefully — the Service will attempt re-delivery on failure, but does not guarantee delivery within any specific timeframe

We are not liable for losses or damages arising from delayed, failed, or out-of-order webhook delivery caused by network conditions, endpoint unavailability, or incorrect endpoint configuration. Webhook secrets can be rotated via POST /api/admin/rotate-webhook-secret, which provides a 24-hour overlap window for in-flight deliveries.

6. Acceptable use

You may not use the Service to:

  • Violate any applicable law or regulation
  • Engage in money laundering, fraud, or other financial crimes
  • Circumvent or attempt to circumvent spending limits, governance policies, or access controls
  • Transmit data containing malware, viruses, or malicious code
  • Attempt to reverse-engineer, decompile, or extract source code from the platform
  • Exceed your plan's API rate limits in a manner intended to circumvent billing
  • Resell or sublicense API access without our prior written consent
  • Use the Service in any way that could damage, disable, or impair our infrastructure

We reserve the right to suspend or terminate accounts that violate these Terms without notice.

7. Intellectual property

Attestify OS and all associated intellectual property — including the platform, APIs, documentation, trademarks, and software — remain our exclusive property. These Terms do not grant you any ownership rights. We grant you a limited, non-exclusive, non-transferable licence to use the Service for your internal business purposes during your subscription period.

You retain all rights to the data you submit to the Service. By using the Service, you grant us a limited licence to process that data solely to provide the Service to you.

Portions of the Service are open source and available at github.com/attestifyagent/attestify-os. Open source components are governed by their respective licences.

8. Data and privacy

Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described therein.

9. Service levels and uptime

We target 99.9% monthly API uptime. Current and historical uptime metrics are published at attestifyos.com/sla. Benchmark performance data is available at attestifyos.com/benchmark. Scheduled maintenance will be communicated in advance where possible. The published SLA metrics represent our operational targets; they do not constitute a guarantee of specific uptime. In the event of material outages attributable to us, we may offer service credits at our discretion. Service credits are your sole financial remedy for downtime. Credits are not available for outages caused by third-party services (Stripe, Base network, xAI), force majeure events, or your own configuration.

10. Disclaimer of warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, or non-infringement. We make no warranties regarding the accuracy, reliability, or completeness of any AI-generated outputs (including those produced by the xAI/Grok inference layer), routing decisions, budget scoring, or execution results. You are responsible for determining whether the Service is suitable for your use case.

11. Limitation of liability

To the maximum extent permitted by law, Attestify OS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or in connection with your use of the Service, even if advised of the possibility of such damages.

Our total aggregate liability to you in connection with these Terms shall not exceed the total fees paid by you in the 12 months preceding the claim, or USD $100, whichever is greater.

Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot be excluded under applicable law.

12. Indemnification

You agree to indemnify and hold harmless Attestify and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit through the Service.

13. Termination

Either party may terminate these Terms at any time. We may terminate or suspend your access immediately if you breach these Terms, fail to pay fees, or if required by law. Upon termination, your right to use the Service ceases immediately. Stripe subscriptions will be cancelled and no further recurring charges will be made. We will retain your data for the period described in our Privacy Policy, after which it will be deleted.

14. Governing law and disputes

These Terms are governed by the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer in another jurisdiction, you may also have rights under the laws of that jurisdiction which these Terms do not override.

15. Changes to these Terms

We may update these Terms at any time. We will notify you of material changes by email with at least 14 days' notice. Continued use of the Service after the effective date constitutes acceptance. If you do not agree to the updated Terms, you may cancel your subscription before the effective date.
